These Terms of Service ("Terms") govern your access to and use of The Promise Challenge mobile application ("the App"), operated by Mint Labs OOD, a company registered in Bulgaria (company no. 207040615), located at G.S. Rakovski 21, 6303 Haskovo, Bulgaria ("we", "us", or "our").
By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. About the App
The Promise Challenge is a 45-day self-discipline challenge designed to help users rebuild trust with themselves through daily photo-based check-ins. Users choose three small daily habits — one for the body, one for the mind, and one related to food — and track their progress with photos over time.
2. Eligibility
You must be at least 16 years old to use the App. By using the App, you confirm that you meet this age requirement and are legally permitted to use the App in your jurisdiction.
3. Subscriptions, Billing, and Cancellation
The Promise Challenge is offered as an auto-renewing subscription. The available plans, prices, and billing periods are shown in the App before you purchase, and all payments are processed by Apple through your App Store account.
Free trial: the annual plan includes a 3-day free trial. If you do not cancel before the trial ends, it automatically converts to a paid annual subscription and your Apple ID is charged.
Auto-renewal: subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before that period ends. Your Apple ID is charged within 24 hours before the start of each renewal.
Managing and cancelling: you can manage or cancel your subscription at any time in your App Store account settings. Cancellation takes effect at the end of the current billing period, and you keep access until then.
Refunds: purchases and refunds are handled by Apple under the App Store's policies. We do not process payments and cannot issue refunds directly. Any statutory rights you have as a consumer (for example, a right of withdrawal under EU law) are not affected by these Terms.
Price changes: we may change subscription prices. Where required, Apple will notify you and, in regions that require it, ask for your consent before a changed price takes effect.
4. Your Content and Data
You may create daily photo check-ins to track your challenge. These photos are stored locally on your device; we do not access, store, or view them.
The App does not require you to create an account.
How we handle data is described in full in our Privacy Policy at https://mypromise.xyz/privacy-policy. For anything relating to data, the Privacy Policy governs.
5. Acceptable Use
You agree to use the App only for its intended purpose and in compliance with applicable law. You may not misuse the App, interfere with its operation, or attempt to access it in an unauthorized way.
6. Intellectual Property
All content, branding, designs, and code within the App are the intellectual property of Mint Labs OOD. You may not copy, reverse-engineer, reproduce, or redistribute any part of the App without our prior written consent.
7. Health and Wellness Disclaimer
The Promise Challenge is a general wellness and self-improvement tool. It does not provide medical, psychological, nutritional, or other professional health advice, and it is not a substitute for consulting a qualified professional. Always seek the advice of a qualified provider before making changes to your diet, exercise, or health routine. You use the App and act on its content at your own discretion and risk.
8. No Warranties
The App is provided "as is" and "as available," without warranties of any kind. We do not guarantee uninterrupted access, error-free performance, or any specific results.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Mint Labs OOD shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of, or inability to use, the App. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
10. Apple App Store
Because the App is distributed through Apple's App Store, the following apply:
These Terms are between you and Mint Labs OOD only, not Apple. Apple is not responsible for the App or its content.
Your licence to use the App is non-transferable and limited to Apple-branded products that you own or control, as permitted by the App Store Usage Rules.
Mint Labs OOD, not Apple, is solely responsible for the App and for providing any maintenance and support. Apple has no obligation to provide support.
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
Mint Labs OOD, not Apple, is responsible for addressing any claims relating to the App, including product liability, any failure to meet legal or regulatory requirements, consumer protection claims, and any third-party intellectual property claims.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as terrorist-supporting, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with any applicable third-party terms of agreement when using the App.
Apple and its subsidiaries are third-party beneficiaries of these Terms, and Apple has the right to enforce them against you.
11. Termination
We may suspend or terminate your access to the App if you violate these Terms or engage in behaviour that disrupts the App's intended use. You may stop using the App at any time by deleting it.
12. Changes to These Terms
We may revise these Terms from time to time. The updated version will always be available within the App or on our website. Continued use of the App after an update constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of Bulgaria, without regard to its conflict-of-law provisions. If you are a consumer in the EU, EEA, or UK, you also keep the protections guaranteed by the mandatory laws of your country of residence.
